Software License Terms and Conditions


  1. DEFINITIONS
    • "PRODUCT" means the computer program sold by us to you and its associated documentation. It does not include source code.
    • "USE" means to install, load, execute, store and/or display the product.
    • "WE", 'US' means Better Software for Schools and Businesses (B.S.S.B.), as trading in the U.K.

  2. GRANT OF LICENSE
    We grant you a personal, non-exclusive, non-transferable license to Use the Product in accordance with the terms and conditions set forth in this agreement. You may not reverse assemble, reverse compile, otherwise translate or discover the source code of the Product.

  3. INTELLECTUAL PROPERTY
    Any and all intellectual property rights in and to the Product belong exclusively to us. You may not remove or destroy any copyright notices or other proprietary markings placed on or contained in the Product.

  4. PAYMENT, LICENSE KEY
    When we have received your payment for the Product we will release to you the License Key that unlocks the functions of the Product on your PC. You agree to send us your Site Code in order for us to generate the License Key for you (where necessary).

  5. GUARANTEE
    We warrant that the Product will function substantially in accordance with the product description published by us. Except as specifically provided for, all other warranties, whether express or implied or however they may arise, are excluded.

  6. LIMITATION OF LIABILITY
    In no event will we be liable for any indirect, special or consequential damages or for any damages in excess of the amount paid by you for the Product giving rise to the liability.
  7. The entire risk arising out of the use or performance of this program and documentation remains with you. B.S.S.B. accepts no liability for damages you may suffer as a result of your use of the program. In no event will B.S.S.B. be liable for any lost profits, lost savings, incidental or indirect damages or other economic consequential damages, even if B.S.S.B. has been advised of the possibility of such damages. In addition B.S.S.B. will not be liable for any damages claimed by you based on any third party claim.

  8. GENERAL PROVISIONS
    • Applicable Law
      The validity, construction and performance of this Agreement will be governed by, and construed in accordance with, the laws of England and the parties submit to the exclusive jurisdiction of the English courts.
    • Entire Agreement
      This Agreement contains all the understandings between the parties on the subject matter of this Agreement and there are no other inducements, warranties, representations or agreements regarding the matters in this Agreement between the parties except as set forth in this Agreement.
